Terms of Service

In short. ArriveCasa is a tool for hosts. It collects guest details and helps you keep track of them, but you remain legally responsible for reporting your guests and for any local taxes. ArriveCasa does not file reports with authorities on your behalf yet, and it is not legal or tax advice.

1. Who these terms are between

These terms are an agreement between Lidus Mila Group SL, a company established in Spain ("ArriveCasa", "we", "us"), and the person or business that creates an ArriveCasa account ("you", the "Host"). ArriveCasa is intended for business use by people who rent out accommodation. By creating an account or using the service you accept these terms.

2. The service

ArriveCasa provides a dashboard for hosts and a check-in link for guests. Guests use the link to give the personal details a host needs to record and report. The host can review, correct and export those details, and track the status of each stay. Features are added over time, and some described on our website may be marked "coming soon" until they are available.

7. Acceptable use

You must not misuse the service. In particular, you must not try to access other users' data, interfere with the service or its security, overload it, submit false or unlawfully obtained information, or use it to break the law or to harass anyone.

8. Personal data

How we handle personal data is described in our Privacy Policy. For guest data, you are the controller and we are your processor under our Data Processing Agreement, which forms part of these terms.

9. Availability and changes

We aim to keep ArriveCasa available and working, but we do not promise uninterrupted service. We may change, improve or remove features, and we will give reasonable notice of changes that materially affect you. Please keep your own copy of anything you must retain by law, for example by using the export function.

10. Intellectual property

ArriveCasa, its design and its software belong to us or our licensors. We give you a limited, non-exclusive right to use the service while your account is active. Guest and booking data you enter or collect remains yours (or your guests').

11. Liability

Nothing in these terms limits liability that cannot be limited by law, including liability for intent or gross negligence, or for death or personal injury caused by negligence.

Subject to that, and to the extent the law allows: the service is provided "as is"; we are not liable for fines, taxes or penalties imposed on you for reports you did not make, made late or made incorrectly, or for indirect or consequential loss, lost profit, or loss of data you were required to back up; and our total liability to you for any claim is limited to the fees you paid us for the affected property in the twelve months before the claim arose.

12. Suspension and ending the agreement

You can stop using ArriveCasa and ask us to close your account at any time. We may suspend or close an account that breaches these terms, puts other users or the service at risk, or where required by law, and we will explain why where we can. On closing, you can ask for a copy of your data and for its deletion, subject to anything we must keep by law.

13. Changes to these terms

We may update these terms. We will change the date above and tell hosts about significant changes in advance. If you keep using the service after a change takes effect, you accept the updated terms.

14. Governing law and disputes

These terms are governed by Spanish law. Courts in Málaga, Spain have jurisdiction, unless mandatory consumer or other protective rules of your country give you the right to use your local courts.
